LGBTQIA+ Rights: A study on the use of judicialization by the Matizes Group in Brazil

The article presents judicialization as a working strategy of the Matizes Group, one of the main LGBTQIA+ social movements in Brazil. The question that guided the research was the following: what strategies are the LGBTQIA+ social movements using to guarantee rights and why the option for judicialization? To answer this question, a quantitative and qualitative research study examined the cases brought before the courts by LGBTQIA+ social movements and the judicialized demands. Four interviews were also conducted with members of the Matizes Group. We show that, in the absence of approval of rights by the Brazilian legislative power, judicialization became part of these social movements’ strategies.

O artigo apresenta a judicialização como estratégia de trabalho do Grupo Matizes, um dos principais movimentos sociais LGBTQIA+ brasileiros. A pergunta que guiou a pesquisa foi a seguinte: quais as estratégias que os movimentos sociais LGBTQIA+ vêm utilizando para garantir direitos e por quê a opção pela judicialização? Para responder a esta questão, a pesquisa quantitativa e qualitativa examinou as proposições levadas ao Poder Legislativo pelos movimentos sociais LGBTQIA+ e as demandas judicializadas. Também foram feitas quatro entrevistas com militantes do Grupo Matizes. Mostramos que, na ausência de aprovação de direitos por parte do poder legislativo brasileiro, a judicialização passou a fazer parte das estratégias dos movimentos.

Derechos LGBTQIA+: un estudio sobre el uso de la judicialización por el Grupo Matizes en Brasil

El artículo presenta la judicialización como estrategia de trabajo del Grupo Matizes, uno de los principales movimientos sociales LGBTQIA+ brasileños. La pregunta que guió la investigación fue la siguiente: ¿qué estrategias utilizan los movimientos sociales LGBTQIA+ para garantizar derechos y por qué la opción por la judicialización? Para responder a la pregunta, la investigación cuantitativa y cualitativa examinó las proposiciones llevadas al Poder Legislativo por los movimientos sociales LGBTQIA+ y las demandas judiciales. También se realizaron cuatro entrevistas con militantes del Grupo Matizes. Mostramos que, en ausencia de aprobación de derechos por parte del Poder Legislativo brasileño, la judicialización pasó a formar parte de las estrategias de los movimientos.
